Acceptance of terms
By starting a conversation with any of the channels operated by MADZ (Messenger, Instagram, WhatsApp) or by using our digital products, you accept these Terms of service. If you do not agree, you may not use the service.
These terms are complemented by our Privacy policy, which forms an integral part of this agreement.
Service description
MADZ is a digital brand operator offering:
- Automated and manual customer support through messaging channels.
- Digital products, courses, and training under proprietary methodologies.
- Shipping coordination and cash-on-delivery payments for e-commerce transactions.
The service is provided with reasonable diligence but does not constitute legal, medical, financial, or specialized professional advice unless explicitly stated.
Eligibility
To use the service you must be at least 14 years old. If you are a minor, you need authorization from your parent or legal guardian.
The service is available to natural and legal persons with legal capacity to enter contracts. We reserve the right to refuse service to anyone without justification.
Payments, transactions and refunds
Cash on delivery (COD) — for physical products, payment is made upon receipt of the product from the courier. MADZ does not process credit or debit card information directly.
Digital products — payment is processed through the provider’s platform (e.g., Hotmart). The customer accepts the payment provider’s terms upon completing the transaction.
Returns — physical products with defects or that do not match the description may be returned within 5 business days of receipt. Digital products and training services are non-refundable once accessed, except for material defect in the content.
Refunds — processed within 15 business days from approval of the return, through the original payment method when technically possible.
User conduct
By using the service you agree to:
- Not send illegal, defamatory, obscene, threatening content or content that violates third-party rights.
- Not use the service for spam, fraud, identity impersonation, or any illegal activity.
- Not attempt unauthorized access to systems, data, or accounts of MADZ or other users.
- Not reverse engineer, decompile, or mass-extract data from the service.
- Not use bots, scrapers, or automated tools without express written authorization.
Non-compliance may result in immediate service suspension and report to competent authorities.
Intellectual property
All products, contents, automated agents, methodologies, software, trademarks, and logos of MADZ are the exclusive property of MADZ or its licensors, protected under applicable intellectual property laws.
By purchasing a digital product or course you obtain a personal, non-transferable, non-exclusive, revocable license to use it according to its description. You may not resell, redistribute, modify, or create derivative works without written authorization.
Content sent by the user (messages, files) remains their property. You grant us a limited license to process it according to the service purpose described in the Privacy policy.
Availability and modifications
We make reasonable efforts to keep the service available, but we do not guarantee uninterrupted or error-free availability.
We may modify, suspend, or discontinue parts of the service at any time. For substantial changes affecting ongoing transactions, we notify with reasonable advance notice when possible.
Limitation of liability
The service is provided “as is” and “as available”. To the maximum extent permitted by law, MADZ shall not be liable for:
- Indirect, incidental, consequential, or punitive damages.
- Loss of data, revenue, business opportunity, or reputation.
- Service interruptions due to causes outside our reasonable control.
Our total liability for any claim related to the service shall not exceed the amount paid by the user in the 6 months prior to the event giving rise to the claim, or one hundred thousand Colombian pesos (COP 100,000), whichever is greater.
Indemnification
You agree to indemnify and hold MADZ and its responsible party harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising from:
- Your use of the service in violation of these terms.
- Your violation of third-party rights.
- Any content you submit to the service.
Termination
You may stop using the service at any time.
MADZ may suspend or terminate your access to the service with or without cause, with or without notice, especially if:
- You violate these terms.
- Your use of the service poses a legal or security risk.
- MADZ discontinues the service in whole or in part.
Clauses that by their nature should survive termination (intellectual property, limitation of liability, indemnification, governing law) shall remain in effect.
Governing law and jurisdiction
These terms are governed by the laws of the Republic of Colombia. For any controversy arising from or related to these terms or the service, the parties submit to the exclusive jurisdiction of the competent courts of Bogotá D.C., Colombia.
In matters of consumer protection, Law 1480 of 2011 and concordant rules also apply. The Superintendence of Industry and Commerce ( sic.gov.co) is the competent authority for claims.
Changes and contact
We may update these terms. Material changes are reflected in the “In effect since” date above. For customers with active transactions, material changes are notified through the original channel.
Continued use of the service after the update constitutes acceptance of the new terms.
